Rules of the Server

THIS IS (IN REAL LIFE) A LEGALLY BINDING CONTRACT BETWEEN YOU AND THE OWNER, OPERATORS, AND MODERATORS (the “Staff”) OF ANY CraftBnay GAME SERVER, OTHER INTERNET PRESENCE, OR COMMUNITY (“CraftBnay” or the “Server”). PLEASE ACTUALLY READ IT CAREFULLY BEFORE USING OR PARTICIPATING IN CraftBnay. BY USING OR PARTICIPATING IN CraftBnay, YOU EXECUTE THIS CONTRACT AND AGREE TO COMPLY WITH ALL OF ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS CONTRACT, THEN DO NOT USE OR PARTICIPATE IN CraftBnay. IF YOU USE OR PARTICIPATE IN CraftBnay IN VIOLATION OF THIS CONTRACT, THEN YOU WILL BE SUBJECT TO CIVIL AND/OR CRIMINAL PENALTIES IN REAL LIFE, AND YOUR ACCESS TO CraftBnay MAY BE REVOKED.

TERMS AND CONDITIONS FOR USE OF OR PARTICIPATION IN CraftBnay

Numbered Rules

  1. CENSORSHIP. CraftBnay has a minimal censorship policy. Profanity is allowed, and users' opinions are not censored, except as provided by this contract.

  1. MINIMUM AGE; LEGAL AUTHORITY. You must be at least eighteen (18) years of age to use or participate in CraftBnay. If you are under 18 years of age but at least thirteen (13) years of age, you may use or participate in CraftBnay only if you behave in a reasonably mature manner. In no event may you use or participate in CraftBnay if you are under 13 years of age.

    By using or participating in CraftBnay, you represent that you have the legal authority to accept this contract on behalf of yourself and any party you represent in connection with your use of or participation in CraftBnay and that you have read, at minimum, the numbered rules in this contract.

  2. ABUSIVE SPEECH. DISCRIMINATION, HARASSMENT, AND/OR OTHER ABUSIVE SPEECH ON THE BASIS OF ACTUAL OR PERCEIVED AGE (EXCEPT AS PROVIDED BY RULE 1), SEX, RACE, ETHNICITY, COLOR, NATIONAL ORIGIN, DISABILITY, GENETIC INFORMATION, FINANCIAL STATUS, MILITARY OR VETERAN STATUS, RELIGION, POLITICAL AFFILIATION, SEXUAL ORIENTATION, ROMANTIC ORIENTATION, GENDER IDENTITY, AND/OR GENDER EXPRESSION; AND/OR ON THE BASIS OF ONE LACKING, QUESTIONING, AND/OR DECLINING TO STATE ANY OR ALL OF THE ABOVE; IS STRICTLY PROHIBITED.

    RAPE JOKES; SEXUAL HARASSMENT, INCLUDING BUT NOT LIMITED TO UNWANTED SEXUAL AND/OR ROMANTIC ADVANCES WHEN THE VIOLATOR KNOWS OR A REASONABLE PERSON WOULD BELIEVE THAT SUCH AN ADVANCE IS UNWANTED; THREATS OF SEXUAL ABUSE, VIOLENCE, AND/OR OTHER CRIMINAL ACTIVITY; THE INTENTIONAL USE OF NAMES, PRONOUNS, AND/OR OTHER WORDS OF AN UNWANTED GENDER TO REFER TO ANY OTHER PERSON; ENCOURAGING ANY OTHER PERSON TO COMMIT OR ATTEMPT TO COMMIT SUICIDE OR OTHER ACTS OF SELF-HARM; HATE SPEECH ABOUT AND/OR DIRECTED AT ANY GROUP PROTECTED BY THIS POLICY AND/OR MEMBER OF SUCH A GROUP, REGARDLESS OF WHETHER THEY ARE AFFILIATED WITH CraftBnay; AND DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION OR SEXUALLY CHARGED IMAGES, VIDEOS, OR TEXT OF, BY, OR ABOUT ANY PERSON WITHOUT EXPLICIT PRIOR CONSENT; ARE ALSO STRICTLY PROHIBITED.

    ANY AND ALL VIOLATIONS OF THIS RULE WILL RESULT IN AN IMMEDIATE AND PERMANENT BAN FROM CraftBnay WITHOUT WARNING AND WITHOUT EXCEPTION.


  3. GRIEFING. No griefers! A griefer is defined as any person who vandalizes or destroys structures, items, or other in-game content without explicit prior consent or who operates an automated or semi-automated process that does so.

  4. CHEATING. Do not cheat. This includes X-Ray hacks; seed abuse; flying, fast movement, or teleportation hacks; Nodus client or similar clients; or any unforeseen tool that gives one an unfair advantage.

  5. ABUSE OF PUBLIC INFORMATION. No information published about the Server's worlds, including seeds or images of sensitive areas, is to be used to gain an unfair gameplay advantage.

  6. There is NO rule six!

  7. ASKING FOR SPECIAL TREATMENT. Do not ask for op or special treatment without valid cause.

  8. CREEPERS. No creepers. If you're unsure if you are a creeper, then this list of symptoms might help.

  9. DISSEMINATION OF UNLAWFUL OR HARMFUL INFORMATION; SUBJECTION TO LEGAL OR POLICE ABUSE. You may not distribute, link to, or provide information on how to access malware; child pornography; other sexually charged images, videos, or text of or about minors; instructions on how to commit real-world acts of violence, sexual abuse, and/or human trafficking, or orders to do so; content that infringes copyright, patents, or trademarks; and/or anything that is unlawful in the United States, the State of Texas, the County of Dallas, Texas, and/or the City of Dallas, Texas; and/or otherwise subject any member of the Staff or any other person affiliated with CraftBnay to civil and/or criminal liability, seizure of property, arrest or detention, and/or police harassment; through CraftBnay.

  10. SPAM. You may not distribute advertising or promotional materials, including junk mail, spam, chain letters, pyramid schemes, or any other form of unsolicited or unwelcome solicitation, through CraftBnay.

  11. MISREPRESENTATION. You may not impersonate another person or entity, or misrepresent your affiliation with a person or entity when using or participating in CraftBnay, except as an obvious attempt at parody or satire.

  12. TECHNICAL DISRUPTION; RESPONSIBLE DISCLOSURE. You may not use any technological means to disable or disrupt the operation of CraftBnay, use or attempt to use any other person's account or personal information in connection with using or participating in CraftBnay, or attempt to gain unauthorized access to CraftBnay, or the computer systems or networks connected to or supporting CraftBnay, through cracking, password mining, social engineering, or any other means.

    Security vulnerabilities must be reported privately to the server owner. You may not exploit such vulnerabilities in a malicious manner. You may not publicly disclose such vulnerabilities until they have been resolved or if all reasonable efforts to cooperate with the server owner have failed.

  13. OBSTRUCTION; RETALIATION. You may not obstruct, prevent, or attempt to obstruct or prevent the enforcement of any rule or other part of this contract. You may not retaliate, threaten to retaliate, or attempt to retaliate against any person as a result of the enforcement of this contract.

General Provisions

The Staff reserves the right to report any violation of this contract to any appropriate law enforcement agency and/or network administrator, and/or seek other legal action, with or without notice to the violator. If you violate this contract while you are under 18 years of age, the Staff also reserves the right to report you to your parent(s), legal guardian(s), and/or school officials with or without notice to the violator.

Your failure or the Staff's failure to strictly enforce or insist on enforcement of any part of this contract is not a waiver of any part of this contract.

All changes to this contract take effect immediately. Provided that changes to this contract are tracked in a version control system, such version control system shall serve as a non-exclusive venue of official notification of changes to this contract.

The Staff may modify, suspend, or terminate the operation of, or access to, all or any portion of CraftBnay at any time for any or no reason. Additionally, your individual access to, and use of or participation in, CraftBnay may be terminated by the Staff at any time and for any or no reason. If you wish to terminate this contract, you may immediately stop using or participating in CraftBnay at any time. Your right to use or participate in CraftBnay terminates automatically upon your breach of any portion of this contract.

Any claim or dispute between you and the Staff arising out of or relating to this contract, in whole or in part, shall be governed by the laws of the State of Texas without respect to its conflict of laws provisions. We agree and you agree to submit to the personal jurisdiction and venue of the local, state, and/or federal court(s) located in Dallas County, Texas and, if applicable, the municipal courts of the City of Dallas, Texas.

To the extent authorized by law, you agree to indemnify and hold harmless the Staff and their employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys fees, resulting directly or indirectly from or arising out of (a) your violation of this contract, (b) your use of or participation in any of CraftBnay, and/or the content you make available on any of CraftBnay.

Covering Our Asses

The disclaimer of warranties, the limitation of liability, and the jurisdiction and applicable law provisions will survive any termination of this contract. Your warranties and indemnification obligations will survive for one year after termination.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE STAFF OFFERS CraftBnay (INCLUDING ALL CONTENT AVAILABLE ON OR THROUGH THE SERVICES) AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE SERVICES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE STAFF DO NOT WARRANT THAT THE FUNCTIONS OF CraftBnay WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT MADE AVAILABLE ON OR THROUGH CraftBnay WILL BE ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY SERVERS OR CLIENTS USED BY THE STAFF ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE STAFF DO NOT WARRANT OR MAKE ANY REPRESENTATION REGARDING USE OF THE CONTENT AVAILABLE THROUGH CraftBnay IN TERMS OF ACCURACY, RELIABILITY, OR OTHERWISE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE STAFF BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF REVENUE OR INCOME, LOST PROFITS, PAIN AND SUFFERING, EMOTIONAL DISTRESS, COST OF SUBSTITUTE GOODS OR SERVICES, OR SIMILAR DAMAGES SUFFERED OR INCURRED BY YOU OR ANY THIRD PARTY THAT ARISE IN CONNECTION WITH CraftBnay (OR THE TERMINATION THEREOF FOR ANY REASON), EVEN IF THE STAFF HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE STAFF IS NOT RESPONSIBLE OR LIABLE WHATSOEVER IN ANY MANNER FOR ANY CONTENT POSTED ON OR AVAILABLE THROUGH CraftBnay (INCLUDING CLAIMS OF INFRINGEMENT RELATING TO THAT CONTENT), FOR YOUR USE OF OR PARTICIPATION IN CraftBnay, OR FOR THE CONDUCT OF THIRD PARTIES ON OR THROUGH CraftBnay.

Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE JURISDICTIONS, THE FOREGOING EXCLUSIONS AND LIMITATIONS WILL BE ENFORCED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

If any rule or other part of this contract is found to be legally invalid or unenforceable, then the rule or other part will be changed as necessary to make it valid and enforceable. If that is not possible, then the rule or other part will be severed and the remainder of this contract will remain intact, valid, and enforceable.

There exists no joint venture, partnership, employment, or agency relationship between you and the Staff as a result of this contract or from your use of or participation in CraftBnay.

The numbered rules are counted starting with the number zero (0). Numbered rules of the form “There is no rule n1” or “Skip to rule n2” are not binding and are included only for comedic purposes. Unless otherwise noted, Internet content referred to by hyperlinks contained in this contract are not binding parts of this contract, and such hyperlinks are included solely for reference purposes. Headings are not binding parts of this contract and exist only for readability purposes.

By using or participating in CraftBnay, you agree that your first-born child, if any, will not become the property of the CraftBnay Staff.

These terms and conditions constitute the entire agreement between you and the Staff relating to your use of or participation in CraftBnay and supersede any and all prior communications and/or agreements between you and the Staff relating to your use of or participation in CraftBnay.

Notes (NOT BINDING)

These notes describe the Staff's intentions in operating CraftBnay. These notes are not part of the rules contract, and they are not legally binding. If anything in these notes is in conflict with the contract, then the contract prevails.

Real-life criminal liability

Violation of the rules would normally be considered a violation of the U.S. Computer Fraud and Abuse Act; 33.02, Texas Penal Code; and other applicable laws. However, it is not our intention for rule violators to be charged with a crime. Therefore, any and all rule violations, with a few exceptions, are hereby allowed for the purpose of computer security laws, but will still result in in-game consequences as described further below.

Rules that, if violated, will result in real-life criminal liability include:

  • Abusive speech (rule 2)
  • Retaliating, threatening to retaliate, or attempting to retaliate against any person as a result of enforcement of the rules contract (part of rule 15)
  • Technical disruptions of CraftBnay or social engineering attacks (part of rule 12)
  • Use of another person's account or personal information (part of rule 12)
  • Malicious exploitation or prohibited public disclosure of security vulnerabilities (part of rule 12)
  • Child pornography or other sexually charged material involving minors (part of rule 9)
  • Instructions on how to commit real-world acts of violence, sexual abuse, and/or human trafficking, or orders to do so (part of rule 9)
  • Subjecting users or staff to civil and/or criminal liability, seizure of property, arrest or detention, and/or police harassment (part of rule 9)
  • Spam (rule 10)
  • Violations of rule 6

In-game Consequences

Capital offenses will result in life banishment without the possibility of parole, and include the following:

  • Abusive speech (rule 2)
  • Retaliating, threatening to retaliate, or attempting to retaliate against any person as a result of enforcement of the rules contract (part of rule 15)
  • Technical disruptions of CraftBnay or social engineering attacks (part of rule 12)
  • Use of another person's account or personal information (part of rule 12)
  • Malicious exploitation or prohibited public disclosure of security vulnerabilities (part of rule 12)
  • Child pornography or other sexually charged material involving minors (part of rule 9)
  • Instructions on how to commit real-world acts of violence, sexual abuse, and/or human trafficking, or orders to do so (part of rule 9)
  • Subjecting users or staff to civil and/or criminal liability, seizure of property, arrest or detention, and/or police harassment (part of rule 9)
  • Spam (rule 10)
  • Violations of rule 6
  • Griefing (rule 3)
  • Cheating (rule 4)
  • Abuse of public information (rule 5)

Non-capital offenses are offenses not listed as capital offenses and will result in one warning on the first offense, and on subsequent offenses life banishment with the possibility of probation after one calendar year.

There is no such thing as a minor offense.

Once the Bnayland Prison has been built, non-capital offenders may be sentenced to imprisonment there as opposed to being outright banned from the server.

Other information

  • Natural ocelot spawning is disabled in the creative worlds because they are annoying-as-fuck horse cuntshits. If you would like ocelots to keep in a contained environment or to tame, you may ask an operator nicely to spawn some for you.
